1. Our Service

Our services involve selling leads to tradies. We provide a lead generation platform for building professionals who agree to work with clients assigned to them. You accept our process of obtaining leads from potential clients.

We reserve the right to modify rates (cost per lead), discontinue, and restrict access to all or part of the Service without notice. We may, at our sole discretion, offer free credits or trial services for a limited period. All credits are considered equivalent to a lead purchase, regardless of value.

2. Eligibility

If you are quoting work requiring sign-off from a Licensed Building Practitioner (LBP), you must be a licensed builder. We will verify your LBP and insurance details to ensure compliance. Other trades not requiring an LBP may be subject to different certification or accreditation requirements.

3. Account Registration

To use certain features of the Service, you must register and: (a) Provide accurate, current, and complete registration information; (b) Maintain the security of your login credentials; (c) Promptly update your registration details to ensure accuracy; (d) Notify us immediately of unauthorised access or security breaches at [email protected].

4. Fees and Payment

Fees apply for using specific features of the Service. Fly Me High reserves the right to implement or change these fees at any time with prior notice.

When purchasing Paid Services via credit card, you authorise Fly Me High Limited or its third-party payment processors to charge your credit card, including applicable taxes. Our payment provider may store your credit card information. Invoices will be issued for periodic billing. All payments are exclusive of GST unless otherwise specified.

5. Invalid Leads

Invalid leads can be disputed following the process outlined at https://flymehigh.com/refunds/. This information is provided upon sign-up. We do not refund leads based on a vendor’s intent.

A dispute can be filed by emailing [email protected], and we will respond within 48 hours with a potential credit. Full refunds (to your credit card) are only issued upon account closure or if we determine the service is not a suitable fit for your needs.

5A. What qualifies as an invalid lead:

- Wrong phone number

- Wrong email

- Wrong address

- Builder or tradie testing our service

- Customer previously quoted prior to engaged with our lead generation

5B. What does not qualify as an invalid lead:

- Customer did not accept the quote

- Customer did not proceed with the deal

- Disputes over work at job completion

- Customer was only seeking an appraisal

- Customer became upset

- Customer chose another tradie using our service

6. User Restrictions

Your right to use the Service is non-transferable. Lead details cannot be shared with third-party marketers or companies. Leads are for your exclusive use only.

We may suspend or terminate your access if you fail to comply with these Terms or if you are not actively purchasing leads.

7. Intellectual Property

We, along with our affiliates and licensors, retain all rights to the Service. No rights are granted to you except those expressly stated in these Terms.

8. Availability and Disclaimer of Warranties

Your use of the Service is at your own risk. No oral or written information obtained from Fly Me High Limited creates any additional warranties beyond those expressly stated here.

9. Term, Cancellation, and Termination

The term of Paid Services begins upon receipt of your payment. You may provide 72 hours notification that you will no longer require leads. Our terms are continuous until one or both parties decide to cancel the agreement.

10. Third-Party Data

Fly Me High Limited is not responsible for third-party content or data integrated into the Service.

11. Links to Other Sites

We may include links to third-party sites, which we do not control or assume responsibility for. You should review their terms and policies before engaging with them.

12. Privacy Notice and Data Processing

We may process personal data under our Privacy Policy, available at www.myrenoquotes.co.nz. By using the Service, you consent to receiving electronic communications from us.

13. Customer Data

You retain rights over any data you provide. However, you indemnify Fly Me High Limited from third-party claims related to data use.

14. Limitation of Liability

Fly Me High Limited is not liable for any indirect or consequential damages arising from your use of the Service. Our total liability is capped at NZD $1,000.

15. Governing Law and Dispute Resolution

These Terms are governed by the laws of New Zealand. Disputes will be resolved through arbitration as per the Unsolicited Electronic Messages Act 2007 or ASA regulations.

16. Changes to Terms

We may update these Terms at our discretion. Continued use of the Service after any changes signifies acceptance of the new Terms.
